ClueMart ("we", "our", "us") is committed to protecting your privacy and complying with the New Zealand Privacy Act 2020. This Privacy Policy outlines how we collect, use, disclose, and protect your personal information when you use the ClueMart mobile application and related services.

  • Profile Details: Stallholder and market organiser profiles, including descriptions, images, and schedules.
  • Payment Information: Billing details and transaction records, processed securely by third-party payment providers.
  • Device and Usage Data: Device type, operating system, IP address, and in-app activity.
  • Location Data: GPS-based location data, collected only with the user's consent.
  • Uploaded Content: Photos, listings, product details, and other user-generated content.
  • Promotions and Sweepstakes: When users participate in ClueMart sweepstakes or prize drawings, we may collect limited information such as name and email address solely for the administration of the promotion.

2.2. Third-Party Provided Information

Where personal information is provided to ClueMart by Event Organisers, schools, Stallholders, or other Users relating to third parties, those Users remain responsible for ensuring that such information has been lawfully collected and disclosed.

ClueMart processes such information as a platform service provider in accordance with this Privacy Policy and the Privacy Act 2020.

ClueMart uses cookies and similar technologies to support core platform functionality, security, and basic usage analytics.

We use your information to:

  • Provide access to and manage your ClueMart account
  • Connect buyers, sellers, and market organisers
  • Display public market and stallholder listings

  • Send service announcements and (with consent) promotional messages
  • Fulfill legal obligations under New Zealand law

4. Sharing of Personal Information

We may share your personal data only when necessary:

  • With other users, in the case of public profiles (stallholders and markets)

ClueMart retains personal and transactional information only for as long as reasonably necessary to fulfil the purposes for which it was collected, comply with legal and regulatory obligations, and resolve disputes, after which such information is securely deleted or anonymised.

As a New Zealand resident, you have the right to:

  • Request corrections to your data
  • Request deletion of your account and associated data
  • Withdraw consent for optional uses of your information (e.g., marketing)

8. Children's Privacy

ClueMart is not intended for use by children under the age of 16. We do not knowingly collect information from minors. If such data is discovered, we will delete it promptly. This does not prevent ClueMart from facilitating school-related campaigns where participation by minors is subject to explicit parental or guardian consent, as described in the applicable promotion rules.

9. International Data Transfers

If you access ClueMart from outside New Zealand, your data may be transferred to and stored in New Zealand or other jurisdictions. By using the app, you consent to these international data transfers, consistent with the Privacy Act 2020. Where personal information is transferred overseas, ClueMart takes reasonable steps to ensure that the recipient provides comparable safeguards to those required under the New Zealand Privacy Act 2020.

10. Updates to This Policy

We may revise this Privacy Policy from time to time. Users will be notified of significant changes through the app or email. Continued use of the ClueMart app implies acceptance of the updated policy.

12. Security, Official Payments and Fraud Prevention

ClueMart is committed to protecting our users from fraud, phishing, and unauthorized data collection. We will never request personal information (such as credit card details, passport numbers, or login credentials) or any form of payment through unofficial channels such as:

  • Emails
  • SMS messages
  • Social media messages
  • Phone calls
  • Direct messages from unofficial accounts

The only valid payment transactions we support are:

  • Subscription fees for Stallholders and optional advertising services
  • Promotional campaign fees (optional, clearly listed inside the app)
  • Small entry fees for voluntary in-app events (e.g. treasure hunts, where stallholders opt-in via the official form)

All payments must be made within the ClueMart mobile application using secure payment providers (e.g. Stripe).

If you ever receive a suspicious message requesting payment or sensitive data outside these official platforms, do not click any links, do not provide any information, and please report it to us immediately at hello@cluemart.co.nz.

Your security is our top priority. We strongly advise you to never trust third-party messages claiming to represent ClueMart unless they are clearly sent through our app or official domain.

ClueMart sends electronic messages only in accordance with the Unsolicited Electronic Messages Act 2007, and users may opt out of promotional communications at any time.

13. Changes to Account Information

Users can update their personal information, including name, email address, and profile details, directly within the ClueMart app at any time.

14. Account Deletion

Users can delete their ClueMart account directly within the app at any time.

To delete your account:

  • Open the ClueMart app
  • Go to Profile
  • Select Delete Account
  • Confirm the deletion

Once confirmed, your account will be permanently deleted, and all personal data associated with your account — including profile information, uploaded content, and activity data — will be irreversibly removed from our systems, except where retention is required by law (e.g. financial or legal obligations).

This action cannot be undone.
